Article 164.310 of the Act, which deals with physical safeguards, states;

(2)(i) Implement policies and procedures to address the final disposition of electronic protected health information, and/or the hardware or electronic media on which it is stored.

(ii) Media re-use: Implement procedures for removal of Electronic protected health information from electronic media before the media are made available for re-use.

Outside of HIPAA, there are other laws such as the Gramm-Leach-Bliley Act (GLBA), Fair and Accurate Credit Transactions Act (FACTA), Federal Information Security Management Act (FISMA), and the Sarbanes-Oxley Act that have made disposing of various forms of data illegal.

Besides healthcare, many other professions including bankers, lawyers and accountants can find degaussing beneficial.
